Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not use our services. These Terms constitute a legally binding agreement between you and Rising Tides Consults LLC.

1. Acceptance of Terms

By accessing and using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of our services, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

We reserve the right to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our services following the posting of any changes to these Terms constitutes acceptance of those changes.

3. Eligibility and Account Registration

3.1 Eligibility Requirements

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements

  • Maintain a valid payment method for applicable services

3.2 Account Security

You agree to cooperate with our credit repair efforts by providing requested documentation, responding to communications in a timely manner, and following our recommendations. Your cooperation is essential for the effectiveness of our services.

5. Payment Terms and Billing

5.1 Service Fees

Our service fees are clearly outlined on our website and in your service agreement. By enrolling in our services, you agree to pay all applicable fees according to your selected payment plan. Fees may include:

  • Initial setup or work fee
  • Monthly service fees
  • Credit analysis fees
  • Additional service fees as applicable

5.2 Payment Authorization

By providing payment information, you authorize us to charge your payment method for all fees associated with your selected services. You represent and warrant that you have the legal right to use any payment method you provide.

5.3 Billing and Collection

Fees are billed in advance according to your payment schedule. If payment is not received when due, we may suspend or terminate your services. You are responsible for any collection costs, including attorney fees, incurred in collecting overdue amounts.

5.4 Refund Policy

We stand behind our services with a 90-day money-back guarantee. If we do not remove at least one negative item from your credit reports within the first 90 days of service, you may request a full refund of fees paid during that period. This guarantee does not apply to educational services or one-time analysis fees.

6. Service Expectations and Disclaimers

6.1 No Guarantee of Results

While we work diligently to improve your credit profile, we cannot guarantee specific results or outcomes. Credit repair results vary significantly based on individual circumstances, including:

  • The accuracy of negative items on your credit reports
  • Your current credit profile and history
  • Your cooperation and financial behavior during the process
  • Credit bureau and creditor responses to disputes

6.2 Timeline Expectations

Credit repair is a process that typically takes several months to complete. While some clients may see results within 30-60 days, others may require 6-12 months or longer to achieve their credit goals. We cannot guarantee specific timelines for results.

6.3 Educational Nature of Services

Our services are educational in nature and designed to help you understand your rights under federal credit laws. We do not provide legal advice, and our services should not be considered a substitute for legal counsel when legal advice is needed.

7. Cancellation and Termination

7.1 Your Right to Cancel

You have the right to cancel your agreement with us within three (3) business days of signing, as required by the Credit Repair Organizations Act (CROA). After this period, you may cancel your services at any time by providing written notice.

7.2 Our Right to Terminate

We reserve the right to terminate your services if:

  • You fail to pay fees when due
  • You violate these Terms of Service
  • You fail to cooperate with our service efforts
  • We determine that our services are not beneficial to your situation

7.3 Effect of Termination

Upon termination, your access to our services will cease, and any outstanding fees will become immediately due. We will provide you with any work product completed up to the date of termination.

8. Limitation of Liability and Disclaimers

8.1 Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Limitation of Liability

To the maximum extent permitted by law, Rising Tides Consults LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use our services
  • Any unauthorized access to or use of your personal information
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, trojan horses, or the like that may be transmitted through our services

8.3 Maximum Liability

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid to us in the twelve (12) months prior to the event giving rise to the liability.

9. Intellectual Property Rights

9.1 Our Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, page layout, underlying code, and software, are the exclusive property of Rising Tides Consults LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our services for your personal, non-commercial use only. This license does not include any right to:

  • Resell or make commercial use of our services
  • Distribute, publicly perform, or publicly display our content
  • Modify or otherwise make derivative works of our services
  • Use our services for any competitive analysis or reverse engineering

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our Privacy Policy and our handling of your personal information as described therein.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Portsmouth, Ohio.

11.2 Dispute Resolution

Before pursuing formal legal action, we encourage you to contact us directly to seek resolution of any disputes. Most concerns can be resolved quickly and to your satisfaction by contacting our customer service team.

11.3 Arbitration

Any disputes that cannot be resolved through direct communication may be subject to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Portsmouth, Ohio, and the arbitrator's decision will be final and binding.

12. Compliance with Laws

12.1 Credit Repair Organizations Act (CROA)

We comply with all applicable provisions of the Credit Repair Organizations Act (CROA) and similar state laws. You have the right to:

  • Cancel your contract within three (3) business days of signing
  • Receive a written contract detailing our services and fees
  • Receive certain disclosures about your rights under federal law
  • Sue for damages if we violate CROA provisions

12.2 Fair Credit Reporting Act (FCRA)

Our dispute process is based on your rights under the Fair Credit Reporting Act (FCRA), which gives you the right to dispute inaccurate or incomplete information on your credit reports. We act as your representative in exercising these rights.

13. Miscellaneous Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any service agreements you sign, constitute the entire agreement between you and Rising Tides Consults LLC regarding the use of our services and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be replaced with a valid and enforceable provision that most closely reflects the original intent.

13.3 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without your consent in connection with a merger, acquisition, or sale of assets.

13.4 Waiver

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by our authorized representative.
